1. About us
This website is operated by Elyvex, a trading name of Morgan Males, a sole trader based in the United Kingdom. Our address is 8 Powtrell Place, Ilkeston DE7 5SW, United Kingdom, and you can contact us at elyvexnutrition@gmail.com. In these terms, "we", "us" and "our" mean Elyvex, and "you" means the person buying from or using this website.
2. These terms
These terms apply to every order you place with us and to your use of this website. Please read them before ordering. By placing an order, you agree to these terms. They do not affect your statutory rights as a consumer.
3. Products
We try to show product colours, sizes and details as accurately as possible, but colours can look slightly different depending on your screen, and measurements may vary by 1–3 cm. Please check the size chart on each product page before ordering.
4. Prices and payment
- All prices are in pounds sterling (GBP). Delivery costs are shown at checkout before you pay.
- Payment is taken when you place your order.
- If we discover a pricing error, we'll contact you before dispatching your order, and you can choose to continue at the correct price or cancel for a full refund.
5. Your order and our contract
After you order, you'll receive an email confirming we've received it. Our contract with you is formed when we dispatch your order. We may decline or cancel an order, for example if an item is unavailable or there's a pricing error. If we do, we'll let you know and refund you in full.
6. Delivery
Delivery costs, times and destinations are set out in our Shipping Policy. Items are your responsibility once they've been delivered to the address you gave us.
7. Cancellations, returns and refunds
You have the right to cancel within 14 days of receiving your items. Full details are in our Refund Policy.
8. Faulty items and your legal rights
We must supply goods that are as described, of satisfactory quality and fit for purpose. If they aren't, you have legal rights under the Consumer Rights Act 2015, including a repair, replacement or refund. For advice about your rights, visit Citizens Advice.
9. Our liability
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that was not foreseeable, or for business losses, as our products are for personal use only. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
10. Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control, such as carrier delays, strikes, severe weather or customs holds. If this happens, we'll contact you as soon as we can and do what we reasonably can to reduce the delay.
11. Website use
All content on this website, including text, images and design, belongs to us or our suppliers and may not be copied or reused without permission. You must not misuse the website, for example by introducing viruses or attempting to gain unauthorised access.
12. Your personal information
We use your personal information as set out in our Privacy Policy.
13. Changes to these terms
We may update these terms from time to time. The version in force when you place your order is the one that applies to it.
14. Law and disputes
These terms are governed by the law of England and Wales. If you live elsewhere in the UK, you can also bring proceedings in your local courts. If you have a complaint, please contact us first and we'll do our best to resolve it.
